3. The Website operates in order to carry out and support the statutory activities of Proventus Foundation in Poland and abroad.
4. The website enables its Users to:
• obtain up-to-date information on the Foundation’s activities,
• make donations to support the Foundation’s statutory activity,
• join the Foundation’s mailing lists.
5. The Foundation exercises all due diligence to ensure that all information available on its website is reliable, complete, true and up-to-date.

III. GENERAL INFORMATION
1. The terms used in the Terms and Conditions shall be understood as follows:
• Purpose – an action/program consisting in the collection of funds for the realization of a specific socially useful purpose, falling within the statutory activity of the Foundation.
• Donor – any legal entity, including an individual, legal person or organizational unit without legal personality, which has made at least one donation in any form to support the statutory activities of the Foundation, in accordance with the provisions of these Terms and Conditions;
• Donation – a donation within the meaning of the common law, in particular the Civil Code, which is an amount of money transferred voluntarily by the Donor in favor of the statutory activity of the Foundation, without, however, making anyone a creditor;
• Partners – entities providing technical support for the Website, Pages, domains;
• Online payment service provider – the payments platform run by Stripe Payments Europe, Ltd (DUNS number: 985420235, adres: C/O A & L Goodbody, Ifsc, North Wall QuayDublinD01 H104, Ireland, https://stripe.com/en-pl/privacy.) facilitating Donors to make Donations;
• User – any legal entity, including natural persons, legal persons or organizational units without legal personality, including Donors, which in any way uses the Website.
2. Before using the Website, each User shall read the provisions of the Terms and Conditions and Privacy Policy.
3. By using the Website, each User unconditionally accepts the entire provisions of the Terms and Conditions and Privacy Policy.

5. Users may make a one-time Donation according to their choice, by paying the amount into the account of the Foundation via Online payment service provider, or a one-time Donation via online banking services (online transfers) or traditional transfers and direct debits (banks, postal services).
6. The Foundation declares that the funds transferred to the Foundation account by Users constitute a donation by the User for the purposes indicated on the Website that fall within the statutory activity of the Foundation.
7. Making a donation does not make anyone a creditor, in particular to the Foundation.
IV. COPYRIGHT, RELATED RIGHTS AND RESPONSIBILITY
1. The Foundation reserves all rights to the Website in accordance with generally applicable law.
2. Copyright, trademarks and other intellectual property rights:
• All rights to the content on the website, such as text, graphics, logos, images, video clips, audio files belong to Proventus Foundation or third parties and are protected by Polish and international intellectual property law. All rights reserved.
• Trademarks and brands may only be used in accordance with these terms and conditions or after you have obtained Proventus Foundation’s written approval.
3. Website content usage:
• The website and its content may not be modified, transmitted, reproduced, published, licensed, transferred, sold or used for any other commercial purpose without Proventus Foundation’s prior written approval.
• The use of the Website, even in part, for any purpose without the consent of the Foundation is prohibited.
• The information accessible through the Website has been compiled from many sources that are not controlled by the Proventus Foundation Proventus. 5. The Foundation takes care of publishing content in a reliable manner, however, the Foundation is not responsible for the consequences of possible use of this content by users or third parties without violating any part of our Privacy Policy.
V. DATA SECURITY AND PERSONAL DATA PROTECTION
1. The administrator of the User’s personal data is the Foundation.
2. The Foundation undertakes to protect personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 and the Act of 10 May 2018 on the protection of personal data (Journal of Laws of 2018, item 1000).
3. By accepting the Terms and Conditions or using the Website, the User agrees to the processing of his personal data by the Foundation, in accordance with the terms of these Terms and Conditions and the principles set out in the Privacy Policy (https://stop-covid-19.expert/en/privacy-policy/), which forms an integral part thereof.
4. The Foundation processes Users’ personal data in accordance with the Privacy Policy only for the purposes of proper use of the Website by electronic means, including transfer of donations and enable the sending of a possible Newsletter to the e-mail address of Users. Processing of personal data for purposes other than those specified above, is possible only after the User gives his consent to the processing of personal data for purposes explicitly indicated by the Foundation.
5. The User has the right to inspect the processed personal data at any time, as well as the right to correct them and request their deletion in accordance with the provisions of commonly applicable law.

VI. FINAL INFORMATION

6. The User may submit a complaint regarding the functioning of the Website by electronic means to the e-mail address of the Foundation: proventus@proventus.org.pl or in writing to the address of the seat of the Foundation.
7. A reply to a properly filed complaint shall be provided by the Foundation within 21 working days in electronic form or in writing to the address of the User known to the Foundation.
8. Complaints on issues related to the functioning of the Online payment service provider shall be handled by the Online payment service provider on the basis of its separate regulations, independent of the Foundation.
9. The Terms and Conditions may be amended by the Foundation at any time, with at least seven days to take effect.
10. The Terms and Conditions are in force from the date of their publication on the website.
11. Matters not covered by the Terms and Conditions shall be governed by generally applicable law, including the civil code and the Law on Personal Data Protection.
12. In the event that any of the provisions of these Terms and Conditions shall be invalid or ineffective, it shall not make the remaining provisions of these Terms and Conditions invalid or ineffective.
13. The court for any disputes related to the operation of the Website shall be the local and materially competent court for the seat of the Foundation.
